Acceptance and Modification. By applying for instruction from Holy Yoga® Global, LLC, the applicant accepts the provisions expressed herein, which provisions may not be modified, amended, or waived except in writing by a duly authorized representative of Holy Yoga® Global, LLC.
Price. Applicant agrees and acknowledges that Holy Yoga® Global, LLC has provided the price of the services for which applicant has enrolled. Specific training programs* require a non-refundable deposit. Promotional offers may not be combined with any other sale, promotion, discount, code, coupon, and/or offer.
*(Specific Training Programs) – 100 Hour Instructor Training, 200 Hour Instructor Training, Masters, Therapy Instructor Training, and the Comeback Track.
Payment. All payments must be made using a debit, credit card, or a check. Class access is not granted until payment clears. No cash will be accepted. Payment in full is due and payable upon the earliest of (i) applicant’s completion of the training, (ii) termination of the applicant’s enrollment, (iii) applicant’s withdrawal from enrollment, (iii) dependent on payment schedule agreement between applicant and Holy Yoga®. Applicant’s termination or withdrawal from the Holy Yoga® Global, LLC training programs will be subjected to the Refund/Credit Policy.

Training Change Policy. If a trainee would like to switch to a later training class, there will be an administration fee of $250 for core training programs*, and a $100 administration fee for **specified training programs. There will be an administration fee of $250 for immersion retreat training changes 30 days prior to your scheduled immersion retreat start date. If a student cancels registration of immersion within 30 days of the immersion retreat event, students will have to pay AGAIN for retreat costs in order to switch to another immersion retreat.
Training Credit Policy. If you desire to withdraw from the training after the refund time frame has closed, a prorated credit is available to you. Assignment and Substitution. The applicant may neither assign its rights in the Holy Yoga® Global, LLC training, nor delegate performance hereunder without Holy Yoga® Global, LLC’s prior written consent, and any attempted assignment or delegation without such consent shall be voidable by Holy Yoga® Global, LLC.
In no event shall such an assignment or delegation constitute a novation.
Continuing Education Credits (CECs). In order for Instructor Trainer Certification to remain valid, Holy Yoga Certified Instructors are to comply with the CEC requirement every three years.
Certification/Certificate/Certificate of Completion Issuance. Training Certification, Certificates, and Certificates of Completion will only be issued upon completion of training payment plans.
Governing Law. This Order and all claims based hereon or arising hereunder shall be construed according to the laws of the State of Arizona; provided that Arizona law shall still govern even if Arizona’s statutes and rules regarding conflict of laws would apply another state’s laws. Unless otherwise expressly waived by Holy Yoga® Global, LLC, jurisdiction and venue for any dispute related to the services or any other dispute between Holy Yoga® Global, LLC and applicant shall be vested exclusively in the Superior Court for the State of Arizona, Maricopa County.
Set-Off. The applicant may not, at any time, deduct or set-off any amount payable by the applicant to Holy Yoga® Global, LLC under this agreement or otherwise from or against any amount payable to the applicant by Holy Yoga® Global, LLC under this agreement or otherwise.
Intellectual Property. By completing the specified training, applicant shall have no rights or title to the “Holy Yoga®” trade name or trademark or such other marks and names as may be utilized by Holy Yoga® Global, LLC except that upon successful completion of the training, applicant may, by separate agreement, be granted a limited use of the Holy Yoga® Global marks and trade names in a manner approved by Holy Yoga®, such granted limited permission is revocable by Holy Yoga® Global, LLC in its sole and absolute discretion. Applicant warrants that he/she is the sole creator and/or owner of all works submitted as homework, test answer material and/or final project/practicum during training and hereby assigns to Holy Yoga® Global, LLC copyrights for said works without reservation or exclusion. Applicant agrees that Holy Yoga® Global, LLC shall from here on own said copyrights, to benefit and dispose of these rights in any way and at its sole discretion.
Severability and Waiver. The failure of either party to enforce any right under this agreement shall not be deemed a waiver of any right. The adjudicated invalidity by a court of competent jurisdiction in whole or in part of any term of this agreement shall not affect the validity of any other term.
No Warranty. All services are provided without and Holy Yoga® Global, LLC hereby disclaims all warranties, express or implied, including, but not limited to, any warrant or merchantability or fitness for a particular purpose.
Remedies. Holy Yoga® Global, LLC’s sole liability and applicant’s exclusive remedy for any claim related in any way to this agreement shall be limited to the amount payable by applicant to Holy Yoga® Global, LLC hereunder. In the event the applicant fails to make payment as provided for hereunder and the matter is placed in the hands of an attorney for collection, the prevailing party in such collection action shall be allowed to recover their attorney fees. Holy Yoga® Global, LLC will not be liable under any circumstances for consequential or incidental damages, including, but not limited to, medical costs or lost profits.
Entire Agreement. This application and established payment plan represent the entire agreement between the parties and no estimate, bid, proposal, or other document, nor any verbal representation or agreement, either before or after execution and submittal of this application, shall affect or modify these terms, except as provided for herein. In the event any portion of this agreement is held to be invalid, illegal, or unenforceable, such portion shall be severed and the remaining terms shall continue in full force and effect.
Amazon Affiliate Disclosure. Holy Yoga® Global, LLC is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com.
HOLY YOGA ® TV – TERMS AND CONDITIONS
By clicking “I AGREE” or “ACCEPT”, or by subscribing to Holy Yoga® TV, you agree to the terms and conditions outlined in this policy.
Payments & Cancellations
Subscription Payments. All payments must be made using a debit or credit card. No checks or cash will be accepted. Subscriptions will automatically renew at the end of the subscription period, unless you cancel your paid subscription before the end of the then-current subscription period.
Subscription Period is defined as one month from the date of purchase.
Price Changes. We reserve the right to adjust the pricing for Holy Yoga® TV, and any element thereof, in any manner and at any time, in Holy Yoga® Global, LLC’s absolute and sole discretion. Except as otherwise provided in this Agreement, any price changes to Holy Yoga® TV, or any element thereof, will take effect following notice to the subscription holder at the email address registered with the subscribers’ Holy Yoga® TV account.
Refunds. There are no refunds for current or past billing cycles, and we do not provide refunds or credits for any partial subscription periods.
Cancellation. Users may cancel at any time. Access will remain until the paid billing cycle closes.
Free Trial Offer. By submitting your payment details, you accept the free trial offer and consent to us using your payment details. After your trial period ends, you will be billed the current monthly rate. If you do not wish to incur this fee you will need to cancel your subscription before the free trial period ends. There are no refunds or credits for partial monthly subscriptions.
Holy Yoga® TV Account
Access and Passwords. The subscriber is responsible for maintaining the confidentiality of their password. The subscriber is fully responsible for all activities that occur under their account subscription of Holy Yoga® TV. The subscriber agrees to keep their password confidential, and to immediately notify Holy Yoga® Global, LLC of any unauthorized use of the Service account.
Intellectual Property. All content provided within Holy Yoga® TV (videos) is property of Holy Yoga® Global, LLC.
Restrictions on Use. The subscriber shall not: (a) decompile, reverse engineer, disassemble, attempt to derive the source code of for any purpose; (b) modify, adapt, improve, or create any derivative work from the Content; (c) violate any applicable laws, rules or regulations in connection with the subscribers access or use of the Content; (d) remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Holy Yoga® Global or its collaborators, suppliers or licensors; (e) use the Content in a manner that derives revenue directly from such use, or use the Content for any other purpose for which it is not designed or intended; (f) enable the use of the Content on a device that is not the subscriber’s device; (g) enable access to or use of Content on a device that is not the subscriber’s device; (h) make the Content available over a network or any other environment permitting access or use by multiple devices or users at the same time; (i) use the Content for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for any services, product or software offered by Holy Yoga® Global, LLC or its licensors; (j) use the Content to send automated queries to any website or to send any unsolicited commercial e-mail; (k) use any proprietary information or interfaces of Holy Yoga® Global, LLC or other intellectual property of Holy Yoga® Global, LLC in the design, development, manufacture, licensing, or distribution of any applications, accessories or devices for use with Content; (l) circumvent, disable or tamper with any security-related components or other protective measures applicable to the Content; or (m) reproduce, archive, retransmit, distribute, sell, lease, rent, exchange, modify, broadcast, synchronize, publicly perform, publish, publicly display, make available to third parties, transfer or circulate the Content. You agree to abide by the rules and policies established from time to time by Holy Yoga® Global, LLC. Such rules and policies may include, for example, required or automated updates, modifications, and/or reinstallations of the Content and obtaining available patches to address security, interoperability, or performance issues. These obligations survive termination of this Agreement.
Holy Yoga® Global Marks. The following company names and their related logos and all related product and service names, design marks and slogans are trademarks and service marks owned by and used under license from Holy Yoga® Global Intellectual Property. You are not authorized to use the Holy Yoga® Global Marks in any advertising, publicity or in any other commercial manner without the prior written consent of Holy Yoga® Global, which may be withheld for any or no reason. These obligations survive termination of this Agreement.
Liability & Injury Disclaimer. The following exercises provided by Holy Yoga® Global, LLC are for educational and entertainment purposes only, and are not to be interpreted as a recommendation for a specific treatment plan, product, or course of action. Not all exercises are suitable for everyone and this or any other exercise program may result in injury. Any user of this exercise program assumes the risk of injury from performing the exercises suggested. Please consult a physician if you have a previous medical condition prior to beginning your practice. Holy Yoga® Global, LLC disclaims any liability from and in connection with this program.
Liabilities & Injury
I have enrolled in an instructor training of physical activity. I release Holy Yoga® Global, LLC, from any liabilities now, or in the future for injury, however caused, occurring during or after my participation with Holy Yoga® Global, LLC. I understand that Holy Yoga® Global, LLC is not responsible for any injury sustained by myself or my students now or at any point in the future. Holy Yoga® Global, LLC, and the instructor training director determine my completion of training. In addition to the physical commitment to practice hours, I also agree to complete and dedicate myself the training session hours set forth in the training guidelines and expectations I have been given. I agree to all terms of completion for the instructor training requirements such as reading, journaling, critiquing, and assisting.
In addition, as a representative of Holy Yoga® Global, LLC, it is my intention to connect people to Christ. I agree to maintain the highest level of integrity and to treat my students with the highest amount of care, respect and love.
We are committed to providing an environment free of illegal harassment. If you feel harassed you must immediately report the harassment by following the procedures set forth in this anti-harassment policy.
Our anti-harassment policy applies to all persons involved in a Holy Yoga® Global, LLC event, including persons involved in the operation of the Company and prohibits harassment by or against any of our volunteers, employees (including supervisors and co-workers), applicants, customers, contractors, or vendors.
Policy Against Harassment
We strictly prohibit harassment based on race, age, sex, religion, color, national origin or ancestry, disability or medical condition, pregnancy, childbirth, marital status or veteran status, genetic information, or any other status protected under state or local laws.
This anti-harassment policy prohibits harassment of, or by, any person involved in our events and operations, including all volunteers, employees, applicants, customers, contractors, or vendors. We will not tolerate any kind of illegal harassment including, but not limited to, slurs, jokes, and other verbal, graphic or physical conduct.
Policy Against Sexual Harassment
No volunteer, employee, applicants, customers, contractors, or vendors, male or female, should be subjected to unsolicited and unwelcome sexual overtures or conduct. Our policy is to prohibit conduct of a sexual nature that could potentially be intimidating, offensive or embarrassing.
Conduct that violates this policy will not be tolerated. No volunteer, employee, applicant, customer, contractor, or vendor, male or female, may sexually harass any other volunteer, employee, applicant, customer, contractor, or vendor by:
(a) Making unwelcome sexual advances or requests for sexual favors as a
condition of an employee’s continued service or the basis for any employment decision affecting the person; or
(b) Creating an intimidating, hostile or offensive working or learning
environment through conduct of a sexual nature.
Inappropriate conduct and comments that may violate this policy include:
Making a sexual or suggestive remark about a person’s body or physical appearance;
Repeatedly asking another volunteer, employee, applicant, customer, contractor, or vendor for a date when that person does not welcome the invitation.
Commenting on/about a person’s social life or describing one’s own sexual experiences;
Joking, teasing, insulting or making an innuendo about a sexual subject;
Using vulgar or profane language or telling dirty jokes;
Touching another person except for accidental or incidental contact;
Staring or looking at another person in an improper way; and/or
Bringing any sexually provocative pictures, drawings, cartoons, calendars or objects into the workplace, or viewing or retrieving such materials on a computer or through any other means.
This policy prohibits harassment regardless of whether the actor is a company volunteer, employee, an applicant, an employee of another company, or a customer. Any offensive or inappropriate conduct should be reported as described below.
Policy Concerning Relationships in the Workplace
We discourage supervisors and managers from close, personal, or intimate relationships with subordinates. Some workplace relationships (even if a supervisor is not involved) can be disruptive to the work environment, create a conflict of interest, and lead to charges of favoritism, discrimination, and sexual harassment. Accordingly, should any two employees begin a relationship, we reserve the right to take whatever action is appropriate, including, job transfer, demotion, or reassignment. If you find yourself in a workplace relationship, you must alert the Director of Human Resources to that fact so that we can take measures to avoid disruption of our work environment.
We take reports of illegal harassment very seriously. All volunteers, employees, applicants, customers, contractors, or vendors have a duty to report any conduct that they believe violates our anti-harassment policy. If you believe that you have been harassed in any way, or if you believe that you have witnessed the harassment of any volunteer, employee, applicant, customer, contractor, or vendor, you must report the incident immediately in accordance with the following procedure so that the matter can be resolved quickly and fairly:
(Step 1) If you are comfortable doing so, talk to the harasser and tell him or her that you are offended by the conduct and that it must stop.
(Step 2) IN ALL CASES, Report the offensive conduct to the Chief Operating Officer, Lea Benson at firstname.lastname@example.org, or any member of management with whom you feel comfortable.
Any member of management who receives a complaint alleging conduct in violation of this policy must report it immediately to the Chief Operating Officer, Lea Benson at email@example.com.
We will promptly, thoroughly, and objectively investigate all allegations of harassment. If we determine that our anti-harassment policy has been violated, we will take effective remedial action that is appropriate under the circumstances. Any company employee who violates our anti-harassment policy will be disciplined, up to and including discharge. Any volunteer, customer, contractor, or vendor who violates our anti-harassment policy may be asked to cease its relationship with us, including being asked to discontinue participation with our training programs and will forfeit any payments or costs made to the Company.
We will not retaliate against anyone who makes a report of harassment, participates in a harassment investigation, or was allegedly harassed. We will instruct all those involved in any harassment complaint that retaliation in any form against the person reporting the harassment, participating in a harassment investigation, or who was allegedly harassed will not be tolerated. Anyone found to be engaged in retaliation in violation of this policy will be subject to appropriate discipline, up to and including termination, including being asked to discontinue participation with our training programs and will forfeit any payments or costs made to the Company.
RECEIPT OF HARASSMENT FREE ENVIRONMENT ACKNOWLEDGEMENT & AGREEMENT
I acknowledge that I have received and read the Holy Yoga® Global Harassment Free Policy & Procedures. I understand that I must abide by the policy as a condition of volunteering, employment, contractual relationship, or participation in any/all training and that any violation may result in disciplinary action up to and including discharge of employment, voiding contractual agreements, including by being asked to discontinue participation in our trainings, forfeiting any payments or costs made to the Company, including forfeiting any refunds.
I understand that Holy Yoga® Global is committed to maintaining an environment that is free from harassment based on an individual’s race, age, sex, religion, color, national origin or ancestry, disability or medical condition (or perception of such disability), pregnancy, childbirth, marital status or veteran status, or any other status protected under state or local laws. Specifically, the sexual harassment prohibited by this policy includes unwelcome sexual advances, request for sexual favors and other verbal or physical conduct of a sexual nature by supervisory personnel, co-employees, volunteers, vendors, or customers.
I understand that actions of this nature have no place in the Holy Yoga® Global environment including Holy Yoga® Global’s training programs and that harassment and intimidation by any employee (including supervisors and co-workers), volunteers, applicants, customers, contractors, or vendors will not be tolerated. If I believe I have been harassed, I agree to immediately contact the Chief Operating Officer at firstname.lastname@example.org, or any member of management with whom you feel comfortable. I understand that Holy Yoga® Global prohibits retaliation against anyone for reporting harassment, participating in a harassment investigation, or who was allegedly harassed.

The HOLY YOGA® Trademarks are important business assets of Holy Yoga® Global, LLC and should be treated with a high level of care. People around the world, including us, rely on our Trademarks to identify our products and services and to distinguish them from those of our competitors. As the creators and global leaders in yoga training programs, we take great pride in our products and services and work relentlessly to improve them. We believe our passion for excellence is unrivaled.
If our Trademarks becomes “generic” in a particular area, they would cease to identify our Company as the exclusive source of products and services on which they appear. Accordingly, anyone would be able to use our marks without concern of a trademark infringement claim, creating confusion in the marketplace.
We respectfully request that you support our efforts to enforce the HOLY YOGA® Trademarks and take steps to use them properly and avoid confusion or misuse. If you have any questions concerning the proper use of the HOLY YOGA® Trademarks, contact us at email@example.com..
The word HOLY YOGA® was coined by us, and is an arbitrary and fanciful word we selected as the original brand name that identifies our programs and related products. The HOLY YOGA® brand name and related word and logo trademarks should only be used to indicate the source of our particular programs and related products and should not be used to refer to any other programs, products or services.
THE HOLY YOGA® TRADEMARKS
Trademark offices around the world provide us with legal means for protecting consumers, licensees, distributors and our Company from third parties that imitate, infringe and/or counterfeit our products or services. These rights include the exclusive right to use our Trademarks in the countries where they are registered. Our registered Trademarks enjoy a presumption of validity around the world. Proper use of our Trademarks serve to distinguish our products and services from those of other companies, prevents the likelihood that consumers will be confused, and helps prevent damage to our marks, including, for example, tarnishment, dilution and genericization. In the United States, HOLY YOGA® is registered trademarks owned by our Company.

All individuals who are “Certified” Holy Yoga Instructors and continue to stay current with their CECs may use the Holy Yoga Certified Instructor logo provided by Holy Yoga Global, LLC.
All individuals who are:
Enrolled in our CORE Membership program;
“Certified” Holy Yoga Instructors; and
Continue to stay current with their CECs
May use the Holy Yoga Certified Instructor logo provided by Holy Yoga Global, LLC. and have the right to use the HOLY YOGA® Trademark and logo as outlined in the Core Membership Terms and Conditions.

Only Holy Yoga and its authorized partners can use the HOLY YOGA® Trademarks on merchandise like CD’s, DVD’s, fitness equipment, footwear, clothing and accessories and other products. So, never use the HOLY YOGA® Trademarks on merchandise (e.g., Don’t make shirts and put the HOLY YOGA® Trademarks on the shirt).
USE OF THE HOLY YOGA® LOGOS:
The HOLY YOGA® Logos were designed to designate products and services developed by our Company and may be used by licensees in their exact form and only to advertise and promote our programs, products and services.
