Waiver and Release of Liability

I (“Participant”) desire to participate in Holy Yoga® Global, LLC ’s Holy Yoga Retreat (the “Retreat”). In consideration for being my participation in the Retreat, I, the undersigned, hereby freely, voluntarily, and without duress executes this Release under the following terms:

Representation. Participant will observe all rules and regulations issued by Holy Yoga Global, LLC . Participant knowingly agrees to conduct himself/herself in a safe and prudent manner and to assume all risks and liability associated with participation in the Retreat, both known and unknown, including injury, claims or other damages.

COVID-19 Acknowledgement. I understand and certify that I have read and agree to comply with the COVID-19 Retreat Rules and Procedures attached hereto as Exhibit A. initial

Release and Waiver. I hereby freely and voluntarily release, waive, discharge, and indemnify Holy Yoga Global, LLC and their officers, directors, agents, assigns, affiliates, contractors, volunteers and employees (the “Released Parties”) from any and all claims, liability, injuries, losses, damages, or costs of any kind or nature that arise from, are caused by, or are related in any way to the Retreats. In addition, I agree to indemnify and hold the Released Parties harmless from any loss, liability, damage, or cost which they may incur as a direct or indirect result of my participation in the Retreats, including damage to Holy Yoga Global, LLC ’s equipment and property.

I acknowledge, fully understand, and agree that I am providing Holy Yoga Global, LLC with a release, waiver, and covenant not to sue regardless of the actual, potential, or alleged cause of any injury, harm or damage to me and whether or not the injury, harm, or damage was caused, potentially caused, or alleged to be caused by: (i) my own actions or inactions; (ii) the actions, inactions, or negligence of any kind whatsoever of Holy Yoga Global, LLC ; and (iii) the actions, inactions, or negligence of any kind whatsoever of any third party. I further agree that I nor the Participant nor our assignee or heirs shall never bring, commence, prosecute, or participate in any action, suit, or other proceedings against Holy Yoga Global, LLC arising out of, concerning, or related to, Participant’s participation in the Retreat, or the actions, omissions, or negligence of Holy Yoga Global, LLC .

Travel. I understand that I am responsible for my air and ground transportation to and from Lost Canyon.

Media Release. Participant further consents to the unrestricted use in any form of any photographs, interviews, film, videotapes, other visual or auditory recordings, in any medium (including the Internet), of Participant that Holy Yoga Global, LLC or others may create in connection with Participant’s participation in the Retreat. Participant waives any right to inspect or approve the finished product and acknowledges that he/she is not entitled to any compensation for creation or use of the finished product.

I have read, understand, and will abide by each of the terms and conditions of this WAIVER AND RELEASE OF LIABILITY. I am of legal age to accept these responsibilities AND I agree to be legally responsible for the obligations described in this WAIVER AND RELEASE OF LIABILITY and agree to be bound by its terms.

Exhibit A

(COVID-19 Rules and Procedures)

I understand that I will be required to meet the requirements of Holy Yoga® Global, LLC and the requirements of the facility where the Retreat and/or event is being held. Failure to follow these rules will constitute my immediate discharge from the Retreat and/or event and no refund will be issued to me. Additionally, should I choose to leave the campus for any reason other than medical needs acknowledged by the facility nurse, I will immediately be discharged from the Retreat and/or event and will not be issued a refund.
I understand that in order to attend the Retreat, I must be free from COVID-19 symptoms. I will immediately notify Holy Yoga Global, LLC if I exhibit COVID-19 symptoms, or if I have had close contact with any individual who has been diagnosed with COVID-19. The CDC defines “close contact” as being within 6 feet of an infected person for at least 15 minutes starting from two days before illness onset (or, for asymptomatic patients, two days prior to specimen collection) until the time the patient is isolated.
I understand that face coverings are required at all times inside of indoor spaces, or any time guests are not able to be physically distanced with the exceptions: (1) in your cabin and (2) while eating in the dining hall. Every guest (participant, instructor, work crew, and staff) is required to bring their own face covering; enough for each day of the Retreat. Each cabin is expected to maintain social distancing guidelines from other cabins.
I understand that I will be required to wash my hands throughout the Retreat using CDC-recommended handwashing procedures.
I understand that no drop-in or day guests will be allowed on the property.
I understand that my temperature will be taken each day. If my temperature is 100.4 or above, I will be required to isolate.
If I contract COVID-19 or develop symptoms of illness prior to participating in the Retreat, I agree to work with Holy Yoga Global, LLC to reschedule my participation in the Retreat once I am free of COVID-19 symptoms for at least ten (10) days.
I understand that if I contract COVID-19 or am suspected of contracting COVID-19 or any virus while participating in the Retreat, Holy Yoga will follow the guidelines of Lost Canyon which are subject to change. Holy Yoga will make every effort to accommodate the needs of the participant while at Lost Canyon and assist with the coordination from Lost Canyon or transportation to a selected lodging outside Lost Canyon if needed. Holy Yoga is not responsible for any expenditures of the participants who must leave Lost Canyon for any reason.

I understand that Holy Yoga® Global, LLC will continue to follow the guidelines of both the CDC and state and local officials. As changes occur, participants will be notified. Holy Yoga Global, LLC will contact the Arizona Department of Health Services if any staff member or participant contracts COVID- 19 to help make crucial decisions on next steps and facilitate contact tracing.
I understand that, while I participate in the Retreat, I will be in contact with employees who are also at risk of community exposure. I understand that due to the nature of the Retreats, social distancing is not always feasible. I understand that no list of restrictions, guidelines, or practices will remove the risk of exposure to COVID-19.
I understand that of my initial payment $250 is non-refundable when I select pay in full or payment plan. The balance of the retreat, if a payment plan is selected, remains due in full no later than September 18, 2021 even if I should choose to cancel or not participate. I acknowledge that my registration cannot be transferred to future Holy Yoga retreats. If payment is not made by September 18, 2021, the total paid is non-refundable, and the purchaser will not be able to participate in the retreat. If the purchaser cancels within 30 days of the retreat, the total retreat purchase is non-refundable.
I understand that if Holy Yoga Global cancels the in-person Holy Yoga Retreat, I agree to participate in an alternate Retreat, the Holy Yoga Virtual Retreat. If the alternate Retreat is initiated, I will receive a refund in the amount of $895.00. The refund will occur within two weeks of notification that the Retreat has been canceled, and each participant will be notified when their refund has been processed. Note: All individuals who purchased the 200- and 100-hour training (where Immersion/Retreat was part of their training) are excluded from this refund policy.
